Strawberry Picking Terms and Conditions

Scope of Application of these Terms and Conditions

These terms and conditions apply to customers who reserve and use the strawberry picking service (hereinafter referred to as “service”) provided by Tanakaen (hereinafter referred to as “this garden”).

 

Agreement to Terms and Conditions

(1)You may use the Service upon agreeing to these Terms of Use.

(2) A contract of use in accordance with these Terms and Conditions shall be deemed to be formed when a customer uses the reservation system (including telephone, web, and in-store visits) of the Garden.

(3) If the customer is a minor, the customer must obtain the consent of a parent or guardian before using the service.

(4) The Terms of Use may be revised at the convenience of the Park.

(5) If the Park revises these Terms of Use, it will post a notice on this website.

 

Use of the Service

(1) In consideration for the Service, the User shall pay the fees and payment method separately stipulated by the Park.

(2) The Service shall be used at the time and area designated by the Park.

(3) The Service shall be used in accordance with the Rules for Use of the Service separately stipulated.

(4) The Garden reserves the right to suspend or discontinue the Service at any time depending on strawberry conditions.

 

 

Rules for use of the Service

(1) How to pick and eat strawberries

　a) Regardless of the size, you shall select strawberries that are ripe up to the stem, and shall not pick unripe strawberries.

　b) Do not collect strawberries, but eat each one before picking the next one.

　c) All of the strawberry shall be eaten except for the stem.

　d) In the event that there are leftovers, an additional fee as separately determined shall be paid.

 

(2) Points to note inside and outside the greenhouses

　a) Clients shall always follow the instructions of the staff to use the service.

　b) No large bags, briefcases, or other luggage may be brought into the House.

　c) Small children must be supervised by a parent or guardian throughout the use of the service.
 

Prohibited acts

(1) Taking strawberries out of the greenhouses

(2) Bringing pets and attendants into the greenhouses.

(3) Smoking inside or outside the greenhouses

(4) Behavior that causes inconvenience to neighbors (loud talking, trespassing on residential property, throwing garbage into the house, etc.)

(5) Entering fields or residences unrelated to the service or touching crops, etc.

(6) Nuisance acts of not coming to the park without prior notice after making a reservation for the service.

(7) Using the service by registering information of a person other than the person who made the reservation.

(8) Other acts that the Garden deems inappropriate based on reasonable grounds.

 

Penalties for those who violate the Terms of Use

(1) The Park reserves the right to suspend or discontinue the use of the service or refuse a reservation request if any of the following events occur

　a) If the customer violates any item of these Terms of Use

　b) If the customer interferes with the operation of the Service, regardless of the means used.

(2) The Park shall not be liable for any loss or damage incurred by the client as a result of any action taken by the Park in accordance with this item.

Compensation for Damages

(1) The Client shall indemnify the Garden for any damage caused to the Garden in connection with the Client's violation of these Terms of Use or use of the Service.

Disclaimer of Liability

(1) The Park shall not be liable for any damages caused by any change, interruption, or termination of the service.

(2) The Park shall not be liable for any damages incurred by the user, directly or indirectly, as a result of the use of the Park's reservation.

(3) This provision shall not apply in the event of gross negligence on the part of the Park, or in the event that the contract falls under the category of consumer under the Consumer Contract Act.

(4) Even if the preceding paragraph applies, the Park shall not be liable to compensate for any damage caused to the user due to negligent acts, and shall not be liable for any damage caused by special circumstances.

(5) In the event that the Park is liable for damages in connection with the use of the Service, the Park shall be liable for damages up to the amount of money received from the client at the time the relevant damages occurred.

(6) The Park shall not be responsible for any disputes or problems between Clients, and Clients shall be responsible for resolving such disputes or problems among themselves, and shall not make any claims against the Park.

 

 

Laws of Jurisdiction, Court of Jurisdiction

(1) The validity, interpretation, and performance of the Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

(2) Any argument, lawsuit, or other dispute between the Garden and the Customer shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court, depending on the amount of the suit.
